Applicant represents that all of the above statements are true and complete and hereby authorizes verification of such information. Applicant is aware that Lessor shall rely on such information, which may or may not be verified, in making the decision to approve this application. Information given above determined to be false, either before or after approval of this application, shall be grounds for owner's disapproval of this application, forfeiture of any application deposit(s) by applicant, and/ or termination of right of occupancy; further, it may constitute a serious criminal offense under the laws of this State. Pertinent Lease Information and Special Conditions 1. Renter’s Insurance Requirement. Prior to taking possession of the apartment, the applicant must provide proof of renter’s liability insurance in the amount of $100,000. The applicant must maintain renter’s insurance throughout the term of the lease and any extensions or month-to-month residency. Insurance may be purchased through MRG’s preferred provider (Assurant) or from a company of the applicant’s choosing. Should the applicant elect to use a third-party insurer, the policy’s declaration page naming Insurance Tracking, PO Box 979166, Miami, FL 33197-9166 as the Interested Party must be provided at the time that the lease is signed. Without proof of renter’s insurance, we are not able to execute a lease agreement. 2. Application Fee (not refundable). Applicant must deliver to lessor an 'Application Fee' which defrays the cost of the credit report, necessary to verify applicant's credit, and a criminal background check. 3. Administrative fee (not refundable). Applicant must deliver to lessor an 'Administrative Fee' which partially defrays the cost of the administrative paperwork. 4. Reservation Deposit. Applicant has deposited a “Reservation Deposit” in the amount stated above. In return, Lessor agrees to reserve an apartment unit of the above described type while Owner considers approval of Applicant and Co-Applicants. Co-Applicants are other persons who are listed as “Residents” above or in the attached Lease Agreement. Upon acceptance of the Rental Application by the Owner or Agent, the Reservation Deposit will no longer be refundable. 5. Withdrawal / Disapproval of Application. The Application Fee, the Administrative Fee, and the Reservation Deposit may not be withdrawn by Applicant or any Co-Applicant. If Applicant or any Co-Applicant withdraws his/her application or notifies Lessor that he/she has changed his/her mind about taking the unit after Lessor has approved the application for rental, the Reservation Deposit of all applicants will be retained by Lessor as liquidated damages. Applicant and all Co-Applicants must sign the Lease Agreement within three (3) days after receiving notice of Lessor’s approval; failure to do so will result in Owner retaining Reservation Deposit as liquidated damages. The Reservation Deposit will be refunded only if Owner disapproves Applicant or any Co-Applicant. 6. Security Deposit. Once the Resident takes legal possession of the premises, the monies held initially for the Reservation Deposit will be transferred and held for the related Security Deposit. 7. Payment. Makowsky Ringel Greenberg, LLC, accepts checks and money orders for processing fees. MasterCard®, Visa®, Discover®, and American Express® are accepted through PayLease®. Transaction fees will apply. PRE-RENTAL CRIMINAL BACKGROUND INVESTIGATION CONSENT FORM MAKOWSKY RINGEL GREENBERG LLC, conducts criminal background investigations on all prospective residents 18 years of age or older in accordance with applicable federal and state law. An unsatisfactory criminal background check revealing a serious charge including, but not limited to, conviction of a felony or deferred adjudication of a felony or a misdemeanor for a crime against a person, or property, or illegal manufacturing or delivery of a controlled substance will result in denial of the application. Not all crimes disqualify prospective residents. Crimes that result in denial of residency are those which pose a serious threat to the health, safety, and welfare of persons living and working in our apartment community, taking in account not only the type of crime, but also the circumstances under which it occurred. In the event the criminal background check reveals any pending criminal cases, the applicant may be offered residency conditionally upon the dismissal or favorable resolution of the pending charge. If the resident is convicted of the charge, the lease agreement shall be terminated immediately. The fact that we perform criminal background checks does not mean that our residents and occupants have no prior or current criminal histories, and we cannot and do not guarantee that this community is free from crime. There may be resident or occupants that have resided in our community prior to this requirement going into effect. Additionally, our ability to verify this information is limited to the information made available to us by the resident credit reporting services used. The undersigned applicant (“Applicant”) by signing where indicated below, hereby authorizes MAKOWSKY RINGEL GREENBERG LLC either directly or through a third party service provider to investigate Applicant’s criminal history record and to review any information pertaining to Applicant which may be maintained by any Federal, State, or local law enforcement agency.
